ExperienceMichele Masucci joined Nixon Peabody in May 2004, following her tenure as a partner in the Health Law Department in McDermott Will & Emery’s New York office. Ms. Masucci represents a wide variety of for-profit health care providers with particular experience working with the federal health care reform legislation (the Patient Protection and Affordable Care Act, or PPACA) enacted in 2010, out-of-state clients attempting to navigate the New York regulatory environment, and acting as regulatory counsel in connection with mergers and acquisitions. Ms. Masucci acts as general and special health care regulatory counsel for numerous health care companies, including specialty pharmacies, dialysis companies, retail based clinics, medi-spas, imaging companies, ambulatory surgery companies, and large physician practices. She frequently provides health care regulatory advice in connection with mergers and acquisitions and financing arrangements, and has represented physicians in connection with joint ventures with business corporations, as well as tax-exempt hospitals. She has represented physicians and physician groups in their organization and in connection with ongoing business and regulatory issues, including formation and buy-sell agreements, and advises them regularly on fraud and abuse and Stark issues. She also has experience working with health care providers on insolvency and bankruptcy matters. Ms. Masucci is a member of the firm’s Health Care Transactions team and Life Sciences team. Ms. Masucci has lectured extensively on transactional and managed care issues and HIPAA compliance matters.
