Nixon Peabody Secures Legal Victory on Behalf of Scottsdale Insurance, an affiliate company of Nationwide Insurance

San Francisco, CA. The U.S. Court of Appeals for the 9th Circuit has ruled in favor of Nixon Peabody client Scottsdale Insurance, an affiliate of Nationwide Insurance.

The plaintiff (a terminated agency) sued Scottsdale and related entities for more than $25 million. Those claims were dismissed on summary judgment. Scottsdale’s legal team went to trial on the counterclaim for unpaid premiums to affiliate Western Heritage, and was awarded the entire amount requested. The plaintiff appealed the judgment, and Nixon Peabody cross-appealed since Scottsdale’s request for prejudgment interest was denied. The 9th Circuit Court affirmed the judgment in favor of Scottsdale, reversed the trial court in its denial of prejudgment interest, and awarded Scottsdale costs on appeal.
