Nixon Peabody Names New Leader of Litigation Department; Fred A. Kelly, Jr., Will Lead 300+ AttorneysNew York, NY. International law firm Nixon Peabody LLP has named Fred A. Kelly, Jr., as the chair of the firm’s Litigation Department, which includes more than 300 attorneys. Primarily a trial lawyer, Mr. Kelly works extensively with companies in the pharmaceutical, medical device, and biotechnology industries. Mr. Kelly has been at Nixon Peabody for more than 25 years and has served in a variety of leadership roles. Mr. Kelly has successfully litigated and tried many types of disputes in the areas of intellectual property and patent licensing, false advertising, trademark infringement, off-label promotion of pharmaceutical and biotechnology products, average wholesale pricing, consumer privacy, executive compensation, false claims, misappropriation of trade secrets and proprietary information, restrictive covenants, co-promotion agreements, products liability, and design and supply agreements. Mr. Kelly was also national trial counsel for a medical device manufacturer in a consolidated multidistrict litigation proceeding where he tried several cases to defense verdicts. He currently spends much of his time representing pharmaceutical and biotechnology companies in False Claims Act cases and class actions brought under RICO and state consumer protection statutes.
